Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of BookMo, an AI-powered Facebook Messenger receptionist service operated by BOOKMO INFORMATION TECHNOLOGY SERVICES, a sole proprietorship registered with the Philippine Department of Trade and Industry (DTI Business Name No. 8362154) ("BookMo," "we," "us," or "our").

By subscribing to BookMo, accessing our dashboard, or otherwise using our services, you ("Client," "you," or "your") agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use BookMo.

2. Service Description

BookMo provides:

• AI-generated replies to inbound Facebook Messenger inquiries received by clinic Facebook Pages that Client has authorized us to connect
• Lead capture (patient name, phone number) when volunteered during conversation, delivered to Client's designated Google Sheet
• Automated reactivation messaging for dormant patients at configurable intervals
• Performance dashboards and email summaries showing inquiry volume, response rates, and lead counts
• Related workflow automation and reporting

BookMo is a software service. We do not provide medical advice, medical services, or clinical judgment of any kind. Clients remain solely responsible for all medical, clinical, and business decisions.

3. Eligibility & Registration

To use BookMo you must:

• Be at least 18 years old and legally capable of entering into contracts
• Operate a legitimate healthcare-adjacent business (aesthetic clinic, dermatology, dental, or similar) in the Philippines
• Have administrative access to the Facebook Page you wish to connect to BookMo
• Provide accurate business information at signup and keep it current

4. Free Trial

New clients may receive a 7-day free trial upon signup. During the trial:

• Full BookMo functionality is available
• No payment method is required to begin
• You may cancel at any time before the trial ends at no charge
• At the end of the trial, service will pause until you subscribe to a paid plan

5. Subscription and Billing

5.1 Pricing

Current subscription pricing is displayed on getbookmo.com/#pricing. All prices are in Philippine Pesos (PHP) and are subject to change with notice. Existing subscribers will be honored at their locked-in price where such a lock-in was expressly offered (e.g., Founding Member pricing).

5.2 Billing Cycle

Subscriptions are billed monthly in advance. Your first billing date is the day after your free trial ends (or the day you subscribe if you skip the trial). Subsequent billing occurs on the same calendar day each month.

5.3 Payment Methods

We process payments via PayMongo, which accepts GCash, Maya, credit/debit cards, and online bank transfers. You authorize automatic recurring charges on your chosen payment method until you cancel.

5.4 Cancellation and Refunds

You may cancel your subscription at any time from your account or by emailing getbookmo@gmail.com. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for unused portions of a billing period.

5.5 Failed Payments

If a scheduled payment fails, we will retry three times over seven days. If payment still fails, service will be suspended until the balance is paid.

6. Acceptable Use

You agree to use BookMo only in ways that comply with:

• Meta's Platform Policies, Community Standards, and Messenger Platform Policy
• Philippine law, including the Data Privacy Act (RA 10173), Consumer Act, and any healthcare-related regulations applicable to your clinic
• These Terms and our Privacy Policy

You will provide accurate information about your services, prices, and hours so BookMo's AI can respond truthfully on your Page.

7. Prohibited Uses

You may not use BookMo to:

• Send unsolicited bulk messages or spam
• Provide medical diagnoses, prescribe medication, or make treatment recommendations through the AI
• Deceive patients about the nature of the service, prices, or your business identity
• Harass, threaten, discriminate against, or abuse patients
• Circumvent Meta's rate limits, review processes, or platform restrictions
• Scrape, resell, or redistribute BookMo software, data, or intellectual property
• Attempt to reverse-engineer, decompile, or extract BookMo's AI system prompts or workflows
• Use BookMo for any illegal purpose

Violations may result in immediate suspension or termination without refund.

8. Intellectual Property

8.1 BookMo IP

BookMo, including its name, logo, software, workflows, AI system prompts, dashboards, and documentation, is the property of BOOKMO INFORMATION TECHNOLOGY SERVICES. Subscription grants you a limited, non-exclusive, non-transferable, revocable license to use the service — not ownership.

8.2 Client Content

You retain ownership of all content you provide (business name, service descriptions, pricing, brand voice preferences). By providing such content, you grant BookMo a license to use it solely to deliver the service to you.

8.3 Patient Conversations

Conversations between patients and your BookMo-powered Page are owned by you as the clinic operator. BookMo processes and stores these conversations on your behalf under the terms of our Privacy Policy.

9. Third-Party Services

BookMo relies on third-party services to function, including but not limited to Meta (Facebook & Messenger), OpenAI, Google (Sheets & Gmail), DigitalOcean, n8n, and PayMongo. Your use of BookMo may be affected by the availability, changes, or outages of these third parties. We are not liable for third-party service disruptions but will make reasonable efforts to communicate significant issues and restore service.

10. Data & Privacy

Our handling of data is detailed in the Privacy Policy, which is incorporated into these Terms by reference. Key points:

• We do not sell patient data
• Patient conversation data is stored in Google Sheets you have access to
• You may request data export or deletion at any time
• See our Data Deletion page for the patient-facing process

11. Confidentiality

Both parties agree to keep confidential any non-public business information exchanged during the course of the service, including pricing, patient data, business strategies, and technical configurations, except as required by law or as necessary to deliver the service.

12. Termination

12.1 By You

You may terminate this agreement by cancelling your subscription per Section 5.4.

12.2 By BookMo

We may suspend or terminate your account with notice if:

• You violate these Terms
• You are more than 15 days delinquent on payment
• Continuing the service would violate law, Meta policy, or expose either party to significant legal risk

12.3 Effect of Termination

Upon termination:

• Your access to BookMo dashboards and services ends
• The BookMo bot on your Facebook Page is disconnected
• Your patient conversation data remains in your Google Sheet for 90 days, then may be deleted
• You may request earlier deletion via getbookmo@gmail.com

13. Warranty Disclaimer

While we make reasonable efforts to keep BookMo reliable, accurate, and available, we do not warrant that:

• The service will be uninterrupted or error-free
• AI-generated replies will always be perfect or free of hallucination
• Third-party services (Meta, Google, OpenAI, etc.) will remain continuously available
• Any specific business outcome (leads, bookings, revenue) will result from using BookMo

14. Limitation of Liability

To the maximum extent permitted by Philippine law, BookMo's total liability to you for any claim arising from these Terms or your use of BookMo shall not exceed the amount you paid us in the twelve (12) months immediately preceding the claim.

In no event shall BookMo be liable for indirect, incidental, consequential, special, or punitive damages — including lost profits, lost patients, lost revenue, or loss of goodwill — even if we have been advised of the possibility of such damages.

15. Indemnification

You agree to defend, indemnify, and hold harmless BookMo from any claim, damages, or expenses (including reasonable legal fees) arising from:

• Your use of the service in violation of these Terms or applicable law
• Inaccurate business information you provided that led to incorrect AI replies
• Medical, clinical, or business decisions you made based on BookMo output
• Third-party claims relating to your interactions with patients

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of the Philippines. Any dispute arising from these Terms will first be addressed in good faith negotiation between the parties. Unresolved disputes will be brought exclusively before the appropriate courts of the Philippines with jurisdiction over BookMo's registered business address.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced by:

• Updating the "Last Updated" date at the top of this page
• Emailing subscribed clients at their registered email address at least 14 days before changes take effect

Continued use of BookMo after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you may cancel your subscription per Section 5.4.
